Terms of Service

1. Agreement to Terms

Welcome to Kickd ("the App", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of the Kickd platform, including our website, mobile applications, and all related services.

By creating an account, accessing, or using Kickd, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the App. Your continued use of Kickd after changes take effect constitutes acceptance of the updated Terms.

2. Eligibility

To use Kickd, you must:

  • Be at least 18 years of age
  • Be a parent, legal guardian, coach, or authorised club administrator
  • Have the legal authority to agree to these Terms
  • Provide accurate and complete registration information

Important: Kickd is not intended for direct use by children under 18. Children do not create accounts. All child-related data is entered and managed by a parent or guardian. By entering information about a child, you represent that you are the child's parent or legal guardian and have the authority to provide that information.

3. Account Registration and Security

3.1 Account Creation

You may register for a Kickd account using your email address or through a supported OAuth provider (such as Google). You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorised use of your account
  • Not share your account with others or create multiple accounts

3.2 Account Responsibility

You are responsible for all activity that occurs under your account, whether or not you have authorised such activity. Kickd is not liable for any loss or damage arising from unauthorised use of your account.

3.3 Account Termination

You may delete your account at any time through the App settings or by contacting us at hello@kickd.au. Upon deletion, your personal data and associated child profiles will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

4. Use of the App

4.1 Permitted Use

Kickd is provided for the purpose of managing youth football activities, including:

  • Tracking game results, scores, and player statistics
  • Setting and monitoring weekly goals for players
  • Managing team rosters and player profiles
  • Participating in team voting features
  • Viewing team rankings and Player of the Match data
  • Using Kickd Callout to log match statistics hands-free via your device or a connected microphone

4.2 Prohibited Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Submit false, misleading, or inaccurate information
  • Impersonate another person or misrepresent your relationship to a child
  • Attempt to gain unauthorised access to other users' accounts or data
  • Use automated tools, bots, or scripts to access the App
  • Interfere with or disrupt the App's infrastructure or security features
  • Reverse-engineer, decompile, or disassemble any part of the App
  • Use the App to harass, bully, or intimidate any user, including children
  • Scrape, harvest, or collect data from the App without authorisation
  • Manipulate voting features through duplicate accounts or fraudulent activity

4.3 Kickd Callout and Connected Hardware

Kickd Callout is an optional, hands-free way to log match statistics using your device's microphone or a connected boom microphone. By using Callout, you acknowledge and agree that:

  • Callout requires microphone access and, for the boom microphone, Bluetooth; you can manage these permissions in your device settings
  • Callout uses the microphone only to recognise your spoken cues in real time, using an offline, on-device speech model — Kickd does not record, store, or transmit any audio, and only the resulting statistic is saved
  • You are responsible for using Callout appropriately in your surroundings and for complying with any applicable laws and any ground, club, or competition rules on the use of audio equipment, even though Callout creates no recordings
  • Callout relies on automated detection, which may be imperfect; logged statistics may contain errors and should be reviewed, and we do not guarantee their accuracy (see our Disclaimer of Warranties below)
  • Any boom microphone or accessory you connect is third-party hardware supplied by you, and Kickd is not responsible for its performance, compatibility, or safety

5. Child Data and Parental Consent

Kickd is designed with child safety as a priority. By using the App to enter information about a child, you confirm that:

  • You are the child's parent or legal guardian
  • You consent to the collection and use of your child's information as described in our Privacy Policy
  • The information you provide about your child is accurate
  • You understand that limited child information (first name and goals) may be visible to authorised team members such as coaches

You may withdraw consent and request deletion of your child's data at any time by contacting hello@kickd.au.

6. Voting Features

Kickd includes in-app voting features (such as player of the week awards). By using these features, you agree that:

  • You will cast only one vote per voting event using your authenticated account
  • You will not create multiple accounts to influence voting outcomes
  • Voting is conducted in good faith and in the spirit of sportsmanship
  • Kickd reserves the right to void votes or disable voting features if manipulation is detected
  • Aggregated vote results may be displayed to other users within the team

7. User Content

7.1 Content You Submit

You may submit content to Kickd, including player names, goals, game results, and statistics ("User Content"). You retain ownership of your User Content but grant Kickd a non-exclusive, royalty-free licence to use, store, display, and process your User Content solely for the purpose of operating and improving the App.

7.2 Content Standards

All User Content must be accurate, appropriate, and comply with these Terms. We reserve the right to remove any content that violates these Terms or that we deem inappropriate for a platform used by families and children.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use that feedback without restriction or compensation to you.

8. Intellectual Property

All rights, title, and interest in and to the Kickd App — including its design, logo, code, features, and content (excluding User Content) — are owned by Kickd and protected by Australian and international intellectual property laws.

You may not:

  • Copy, modify, or distribute any part of the App without our written permission
  • Use the Kickd name, logo, or branding for any purpose without authorisation
  • Create derivative works based on the App

The Kickd name and logo are trademarks of Kickd. All other trademarks appearing in the App are the property of their respective owners.

9. Third-Party Services

Kickd integrates with third-party services, including:

  • OAuth Providers (e.g., Google) for authentication
  • Cloud hosting providers for data storage and processing
  • Analytics services for anonymised usage data

Your use of third-party services is governed by their respective terms and privacy policies. Kickd is not responsible for the practices or content of third-party services.

10. Availability and Modifications

10.1 Service Availability

We strive to keep Kickd available at all times but do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

10.2 Modifications

We reserve the right to modify, update, or discontinue any feature of the App at any time. We will provide reasonable notice of material changes where possible. Continued use of the App after changes constitutes acceptance of those changes.

11. Disclaimer of Warranties

Kickd is provided on an "as is" and "as available" basis. To the maximum extent permitted by Australian law, we disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the App will be error-free, secure, or uninterrupted
  • Warranties regarding the accuracy or reliability of any content or data within the App

Kickd is a tool for tracking youth football activities. We do not guarantee the accuracy of statistics, scores, or rankings, as this data is entered by users.

12. Limitation of Liability

To the maximum extent permitted by Australian law, Kickd and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, profits, or goodwill
  • Errors, inaccuracies, or omissions in user-submitted content
  • Unauthorised access to or alteration of your data
  • Any interruption or cessation of the App

Our total liability to you for all claims arising from your use of the App shall not exceed the amount you have paid to Kickd (if any) in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Kickd, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the App
  • Your misrepresentation of your relationship to a child whose data you enter

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.

In the event of a dispute arising from these Terms or your use of the App:

  • You agree to first attempt to resolve the dispute informally by contacting us at hello@kickd.au
  • If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts of New South Wales, Australia
  • You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia

15. Termination

We may suspend or terminate your access to Kickd at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Conduct that harms other users or the integrity of the platform
  • Prolonged inactivity (accounts inactive for more than 24 months)

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will continue to apply.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kickd regarding your use of the App. These Terms supersede any prior agreements or understandings, whether written or oral, relating to your use of the App.
